Harbingers of Change in the Legal Systems in INDIA -- "The Judge Kunha & The Justice Kumarasamy Judgement Scientific Reviews"

The Scientific Review of the Judge Kunha and Justice Kumarasamy judgements indicated so many flaws in various processes from complaint, investigations, prosecution witness, assessments, etc. indicating a very high possibility that the defendant Dr. J. Jayalalitha has been framed.

Such a scientific review was NOT done LIVE during the course of any case proceedings in INDIA. The truths that came out of the Scientific Reviews heralded so many improvements and changes for the better in the Police & Judicial Systems including subtle endorsements and appreciations from various quarters (Ref. 2-6).

The latest move by the Govt. of INDIA done at this moment (Ref.1) also indicates that the Scientific Reviews of the aforesaid judgements have also caused improvements in the legal systems too.

Though the Govt. of INDIA cannot publicly acknowledge the Scientific Reviews of the Judge Kunha & Justice Kumarasamy judgements, such a step by the Govt. of INDIA (Ref.1) actually amounts to endorsing and appreciating the Scientific Reviews of the Judge Kunha & Justice Kumarasamy judgements and attempting to change things for the better, though in a discreet subtle way.

நீதிபதி குன்ஹா மற்றும் நீதியரசர் குமாரசாமி தீர்ப்புகளின் அறிவியல் மதிப்பாய்வுகள் ஏகப்பட்ட உண்மைகளையும் குறைகளையும் வெளி கொண்டு வந்தது (கம்ப்ளியின்ட்டில் ஆரம்பித்து, விசாரணை, பிராஸிக்யூஷன் விட்னஸ், அசெஸ்மென்ட், குற்றம் மெய்பித்தல், மற்றும் பல செயல்முறைகளில்).

இந்த குறைகளினால் பிரதிவாதியாகிய முனைவர் ஜெ. ஜெயலலிதா தவறாக குற்றம் சாட்டப்பட்டு, தவறாக குற்றம் மெய்ப்பித்து, தவறாக சிறையில் அடைக்கபட்டாரோ என்ற கேள்விகள் எழுந்தது.

இந்தியாவில், இத்தகைய அறிவியல் மதிப்பாய்வு எந்த ஒரு வழக்கிலும் நேரடியாக இதுவரை செய்யப்படவில்லை. இந்த அறிவியல் மதிபாய்வுகளினால் வெளி வந்த உண்மைகள் சில நல்ல மாற்றங்களை காவல் துறையிலும் நீதி துறையிலும் கொண்டு வந்தது (மேற்கோள் 2 முதல் 6 வரை).

இந்திய அரசு இப்பொழுது எடுக்கும் நடவடிக்கையும், இந்த அறிவியல் மதிப்பாய்வுகள் வழக்கறிஞர் துறையிலும் சில நல்ல மாற்றங்களை கொண்டு வருகிறது என்பதை காட்டுகிறது (மேற்கோள் 1).

இதனை நீதிபதி குன்ஹா மற்றும் நீதியரசர் குமாரசாமி தீர்ப்புகளின் அறிவியல் மதிப்பாய்வுகளுக்கு இந்திய அரசிடம் இருந்து கிடைத்த ஒரு நளினமான பாராட்டாக எடுத்து கொள்ளலாம்.
